Terms and conditions

Article 1. OBJECT

Marketest makes a commitment to each participant that it will ensure the utmost confidentiality and therefore maintain the anonymity of each participant online. Indeed, under no pretext whatsoever will Marketest divulge personal information relating to individual participants (such as their e-mail address, postal address, level of income, marital status, etc.) to any third party in any way, shape or form without the participant's explicit consent.
These terms and conditions disclose the basis on which MIS Group provides its online products and services to the client, through the website Marketest (http://www.marketest.co.uk.). The client must read these terms and conditions before using the online products and services. By clicking the Agreement checkbox the client accepts and is bound by these terms and conditions. This agreement will continue for the term that MIS Group provides the online products and services to the client. MIS Group may change these terms and conditions from time to time. These changes will be effective upon the next renewal..

Article 2. OFFER AND QUOTE

Marketest (MIS Group group) provides tailored online quantitative market research and sell reports on existing research. The quotes that MIS Group submits do not commit MIS Group for more than twelve months after the quote has been handed.

Article 3. PRICE

MIS Group has the right to change its rates anytime but MIS Group promises to respect the price in force provided at the time of order.

Article 4. PAYMENT

Payments are made according to the following procedure: - 30% as a down payment from the quote acceptance date. - 70% upon completion of the service, before the results are handed. 4.2 All payments are made to MIS Group on behalf of Marketest.co.uk. Clients can make the payment by check, PayPal or BACS. The payment by bank cheque is only possible with a cheque in pounds sterling and coming from a United Kingdom bank. The check has to be established to MIS Group and sent to the address below: MIS Group United House, North Road LONDON N7 9DP 4.3 In the case of late payment of the agreed fee, MIS Group would have the right to claim interest for the delay (actual rate charged by finance companies during the past term regarding short term loan).

Article 5. PANEL

The panel chosen to be questioned has been specified by the client in the quote and can't be modified by the client or MIS Group during or after the realisation of the market research except with a signed bilateral agreement.
MIS Group guarantees to get at least the number of answers specified in the quote. If the number of questioned people is lower, a cancellation request of the order and the refund of the down payment will be paid except if there is an agreement between the two parties to continue with the contract.

Article 6. MARKET RESEARCH RESULTS

6.1 Clients have the choice of four different presentation packages for the results of the conducted market research. Below are the different packages:
- BASIC Package: all the survey results (individuals' answers) in Excel (.xls) format - ESSENTIAL Package: BASIC Package + all the frequency tables
- PLUS Package: BASIC Package + all the frequency tables + all the cross tables
- FULL Package: BASIC Package + all the frequency tables + all the cross tables + commentary

6.2 The cross tabulations give the answers by sorting the interviewees into subsets based on criteria such as sex, age, socio-economic group, etc. Specific exchange sorts such as cross tabulations between two questions for example must be discussed and agreed by both parties before accepting the quote. The commentary is a detailed reading of the most relevant results of the survey. Clients can consult market research report examples.

6.3 Through the market research results provided, MIS Group will not communicate the email address of the respondents, except if the respondent's permission has been requested in the questionnaire.

Article 7. OWNERSHIP RESERVATION

The delivered services are still our ownership as long as the client is under our obligations and in particular until the client integrally pay our service.

Article 8. RESPONSABILITY

8.1 MIS Group promises to do all the care in accordance with the profession custom for the implementation of our service. However, the responsibility couldn't be ours if MIS Group does not respect the contractual obligations if it results from an accidental or a case of force majeure (disaster, fire, flood, breakdown of equipment, transport, communication, strike) or because of the client's activities.

8.2 All MIS Group servers are managed in a secure mission critical environment. However, from time to time, delays or interruptions may occur in Marketest providing the online products and services to the client. Clients must acknowledge that MIS Group will not be responsible for any such delay or interruptions and that UB will not have any liability to the client for any failure or delay in delivering the online products or services.

8.3 MIS Group offers links to other sites thereby enabling the client to leave the Marketest website and go directly to the linked site. The Information Commissioner is not responsible for the content of any linked site or any link in a linked site. The Commissioner is not responsible for any transmission received from any linked site. The links are provided to assist visitors to the Information Commissioner's site and the inclusion of a link does not imply that the Information Commissioner endorses or has approved the linked site.

Article 9. PROTECTION OF PRIVATE INFORMATION

All personal information submitted by the client through the use of the online products and services is maintained on secure servers. MIS Group and its suppliers will take all reasonable steps to maintain the confidentiality of and restrict access to this information and will not disclose any of this information to anyone unless required to do so by law. Unfortunately, no data transmission over the Internet can be guaranteed as totally secure. Whilst MIS Group strives to protect such information, it does not warrant and cannot ensure the security of any information that you, the client transmits to MIS Group and any information which is transmitted to us is transmitted at the client's own risk.

Article 10. RETURN POLICY

(After selling an existing market research or providing a new one)
Due to the nature of the information being sold, MIS Group cannot accept returns of products once they have been delivered. Please be sure to read all available information about a report before placing the order.
